In particular, we wish to protect the data of our customers, subcontractors and suppliers against, among other things, loss, leaks, errors, unauthorised access or unlawful processing.

Through this Data Protection Notice, we would like to inform you about the collection and processing of your personal data.

 

We ask that you read this Data Protection Notice carefully, as it contains essential information about how your personal data is processed and for what purposes.

By providing your personal data, you expressly declare that you have taken note of this Data Protection Notice and expressly agree to it, as well as to the processing itself.

This Data Protection Notice applies to all services provided by us and, in general, to all activities carried out by us.

 

3 Data Controller and its Commitments

When collecting and processing your personal data, we comply with Belgian legislation on the protection of personal data, as well as with the General Data Protection Regulation (“GDPR”) since its entry into force on 25 May 2018.

 

4 Personal Data

Depending on your activities and your relationship with our company, you provide us with the following personal data: your identification and contact details (name, title, address, email address, telephone and mobile phone number). For certain specific legal obligations (electronic attendance registration, 30bis declaration of works), you may be required to provide us with additional information to register your attendance (such as E-ID details or Limos number).

Please note that you are responsible for all data you provide to us and that we rely on its accuracy. If your data is no longer up to date, please notify us accordingly.

You are not obliged to provide your personal data, but you understand that certain services or cooperation may become impossible if you do not consent to its collection and processing.

 

5 Purposes and Legal Basis for Processing

 

5.1 Customer Data

In the context of our services and activities, we collect and process the identification and contact details of our customers and clients, their employees, staff members, representatives and other relevant contacts. The purposes of this processing are the performance of agreements with our customers, customer management, accounting and direct marketing activities, such as sending promotional or commercial information. The legal bases are the performance of the agreement, compliance with legal and regulatory obligations (such as the 30bis declaration of works) and/or our legitimate interest.

 

5.2 Data of Suppliers and Subcontractors

We collect and process the identification and contact details of our suppliers and subcontractors, as well as those of their potential (sub)contractors, employees, staff members, representatives and other relevant contacts.

 

The purposes of this processing are the performance of the agreement, management of suppliers/subcontractors, accounting and direct marketing activities, such as sending promotional or commercial information.

 

The legal bases are the performance of the agreement, compliance with legal and regulatory obligations (such as mandatory electronic attendance registration, the 30bis declaration of works, attendance lists or other obligations relating to public contracts, etc.) and/or our legitimate interest (such as for direct marketing).

 

Where applicable, E-ID details or the Limos number will also be processed for electronic attendance registration.

 

For direct marketing activities by email (such as newsletters or invitations to events), consent will always be requested and may be withdrawn at any time.

 

5.3 Employee Data

We process the personal data of our employees in the context of personnel management and payroll administration. Given the specific nature of this processing, it is regulated in greater detail in a Data Protection Policy for employees.

 

5.4 Other Data

In addition to the data of customers, suppliers/subcontractors and employees, we also process personal data of other individuals, such as potential new customers/prospects, relevant contacts within our sector, network contacts, contacts of experts, etc.

The purposes of this processing are related to our business activities, direct marketing and public relations. The legal basis is our legitimate interest or, in some cases, the performance of an agreement.

 

6 Retention Period

We retain and process personal data for the period necessary in view of the purposes of the processing and the (contractual or non-contractual) relationship we have with you.

In any event, customer data and data of suppliers or subcontractors will be removed from our systems after a period of seven years following termination of the agreement or completion of the project, except for personal data that we are required to retain for a longer period under specific legislation or in the event of an ongoing dispute for which the personal data remains necessary.

 

7 Rights

In accordance with and subject to the conditions set out in Belgian privacy legislation and the provisions of the General Data Protection Regulation, we inform you that you have the following rights:

• Right of access and inspection: You have the right to obtain, free of charge, information about the data we hold about you and to verify the purposes for which it is used.

• Right to rectification: You have the right to obtain the rectification (correction) of inaccurate personal data, as well as to have incomplete personal data completed.

• Right to erasure or restriction: You have the right to request that we erase your personal data or restrict its processing under the circumstances and conditions provided for by the General Data Protection Regulation. We may refuse the erasure or restriction of any personal data that is necessary for us to comply with a legal obligation, perform an agreement or pursue our legitimate interest, for as long as such data remains necessary for the purposes for which it was collected.

• Right to data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format. You have the right to transmit this data to another data controller.

• Right to object: You have the right to object to the processing of your personal data on compelling and legitimate grounds. Please note, however, that you cannot object to the processing of personal data that is necessary for us to comply with a legal obligation, perform an agreement or pursue our legitimate interest, for as long as such data remains necessary for the purposes for which it was collected.

• Right to withdraw consent: Where the processing of personal data is based on prior consent, you have the right to withdraw that consent. Such personal data will thereafter only be processed if we have another legal basis for doing so.

• Automated decision-making and profiling: We confirm that the processing of personal data does not involve profiling and that you are not subject to fully automated decision-making.

8 Disclosure to Third Parties

Certain personal data collected by us may be disclosed to and potentially processed by third-party service providers, such as our IT provider, accountant and auditor, as well as by government authorities (for example, in connection with the 30bis declaration of works, electronic attendance registration or participation in public procurement procedures).

It is possible that one or more of the above-mentioned third parties are located outside the European Economic Area (“EEA”). Personal data will, however, only be transferred to third countries that provide an adequate level of protection.

The employees, managers and/or representatives of the service providers or institutions referred to above, as well as specialised service providers appointed by them, must respect the confidential nature of your personal data and may only use such data for the purposes for which it was provided.

Where necessary, your personal data may be disclosed to other third parties. This may, for example, be the case if we were to be wholly or partially reorganised, if our activities were transferred, or if we were declared bankrupt. Personal data may also need to be disclosed pursuant to a court order or to comply with a specific legal obligation.

In such cases, we will make reasonable efforts to inform you in advance of such disclosure to other third parties. However, you acknowledge and understand that this may not always be technically or commercially feasible in certain circumstances, or that legal restrictions may apply.

Under no circumstances shall Tasco Antislip Company powered by Facades Forever BV be held liable for any direct or indirect damage resulting from the incorrect or unlawful use of personal data by a third party.

 

10 Access by Third Parties

For the purpose of processing your personal data, we grant access to your personal data to our employees, staff members and representatives.

We guarantee a similar level of protection by imposing contractual obligations on these employees, staff members and representatives that are equivalent to those set out in this Data Protection Notice.
